The E-1 nonimmigrant visa authorizes a foreign citizen to be admitted to the United States temporarily for the sole purpose of engaging in international trade for substantial benefit on behalf of himself or an organization, always with the goal of continuing the primary trade between the US and the treaty country that qualified it for E-1 classification.

Eligibility Criteria:
- Be a national of one of the countries that maintain a trade and navigation treaty with the United States.
- Continue to promote substantial trade.
- Continue primary trade between the US and the treaty country that qualified you for E-1 classification.
To qualify for the E-1 visa as an employee of a treaty trader, you must:
- Share the same nationality as your main employer.
- Accomplish the requirements that legitimize him as an employee.
- Executing executive or supervisory functions, or being considered an employee with special qualifications
If your employer is not an individual, it must be a business or organization that is at least 50% owned by persons in the US and who have the same nationality as the treaty country. If the owners are in the US, they must maintain nonimmigrant treaty trader status. In the event the owners are not present in the US, they must be classifiable as nonimmigrant treaty traders.
