VISA E-2 Investor by Trade Agreement

Like the E1 Visa, this is considered a nonimmigrant business visa, with the difference that it is intended for people who want to invest a substantial amount of capital in starting or buying a business in the United States. Many of the requirements are the same as E1. Although in this case, the investor doesn’t need to have a business in operation in another country, it is enough to present an excellent point, in which it is verified that the individual has the necessary managerial skills to manage a business in the United States.

Main requirements:

  • Be a national of one of the countries that maintain a trade and navigation treaty with the United States.
  • The individual must own at least 50% of the business in the United States.
  • The applicant must develop and direct the business.
  • The E2 applicant must prove that they have invested or are in the process of investing substantially in the US business before applying for the E-2 visa.
  • The investment company must be a real, active, and operating commercial company that produces services or goods for profit. It cannot be a paper organization only. Furthermore, it cannot be a mere means of supporting the investor.
  • Projected future earnings must be achievable within 5 years from the date the applicant begins the normal business activity of the business.
  • The E-2 visa applicant must provide a written statement of intent to leave the United States upon the termination of business.
